Definitions 📚
- Birthing parent: the gender-neutral term that refers to anyone who has or will give birth and will/has become a parent. Birthing parents may be eligible for statutory maternity leave.
- Non-birthing parents: the gender-neutral term that refers to anyone who will not give birth and will/has become a parent. This includes biological and adoptive parents. Non-birthing parents may be eligible for statutory paternity, adoptive, or shared-parental leave.
Statutory Benefit:
Maternity Leave or Adoption Leave
- Statutory Maternity Leave/Statutory Adoption Leave is 52 weeks, made up of:
- Ordinary Maternity Leave (OML)/ Ordinary Adoption Leave (OAL)- first 26 weeks
- Additional Maternity Leave/Additional Adoption Leave- last 26 weeks
Maternity Pay or Adoption Pay
- Statutory Maternity Pay/ Statutory Adoption Pay (SMP/AP) is paid for up to 39 weeks. You will receive:
- 90% of your average weekly earnings (before tax) for the first 6 weeks
- £172.48 or 90% of your average weekly earnings (whichever is lower) for the next 33 weeks
- Weeks 39-52 are unpaid
- SMP/AP typically starts when you start your maternity leave/adoption leave
- If you are off work for pregnancy related illness in the 4 weeks before your baby’s due date, SMP will start automatically.
Paternity Leave
- 1 or 2 weeks of Paternity Leave
- Leave must be taken in one go and can’t start before the birth
- Leave must end 56 days after the birth, or due date if baby is early
- The rules are different if you adopt.
Paternity Pay
- £172.48 or 90% of your average weekly earnings (whichever is lower.)
